The "Compulsory National Standard Management Measures" was reviewed and approved by the State Council of Market Supervision and Administration's 16th Bureau Meeting on December 13, 2019, and will be implemented as of June 1, 2020.

Mandatory national standards shall be formulated for technical requirements that guarantee personal health, life and property safety, national security, ecological environment security, and the basic needs of economic and social management.

The formulation of compulsory national standards should adhere to the principle of generality and give priority to the development of standards applicable to products, processes or services that cross fields and specialties.

Mandatory national standards are approved or issued by the State Council.

Social organizations, enterprises, institutions and citizens may submit proposals for mandatory national standards to the standardization administrative department of the State Council.

Mandatory National Standard Management Measures

Article 1 In order to strengthen the management of mandatory national standards and regulate the formulation, implementation and supervision of mandatory national standards, these Measures are formulated in accordance with the "Standardization Law of the People's Republic of China".

Article 3. Mandatory national standards shall be formulated for the technical requirements to ensure personal health and safety of life and property, national security, ecological environment security, and to meet the basic needs of economic and social management.

Article 4 The formulation of compulsory national standards shall adhere to the principle of generality and give priority to the formulation of standards applicable to products, processes or services that cross fields and specialties.

Article 5 The formulation of compulsory national standards shall be based on scientific and technological research results and social practical experience, in-depth investigation and demonstration to ensure the scientificity, standardization and timeliness of standards.

Article 6 The formulation of compulsory national standards shall adopt international standards in accordance with national conditions .

Article 7 The formulation of compulsory national standards shall be open and transparent, and various methods shall be adopted in accordance with the principle of convenience and effectiveness, and opinions of all parties shall be widely listened to.

Article 8 Mandatory national standards shall have clear standards for supervision and administration departments, and shall be able to deal with violations of mandatory national standards in accordance with laws, administrative regulations and departmental regulations.

Article 9 The standardization administrative department of the State Council manages national standardization work in a unified manner, and is responsible for the establishment, numbering, and notification of mandatory national standards. Relevant administrative departments of the State Council are responsible for the submission, organization, drafting, opinions and technical review of mandatory national standards based on their duties. Mandatory national standards are approved or issued by the State Council.

The administrative department for standardization of the people's governments at or above the county level and the relevant administrative departments shall supervise and inspect the implementation of mandatory national standards in accordance with their legal duties.

Article 10 The standardization administrative department of the people's government of a province, autonomous region, or municipality directly under the Central Government may submit a proposal for the establishment of a mandatory national standard to the standardization administrative department of the State Council, which shall be studied and decided by the standardization administrative department of the State Council together with the relevant administrative department of the State Council. If it is really necessary to formulate a compulsory national standard, the department in charge of standardization administration under the State Council shall specify the project proposal department, and the reason for the project establishment shall be explained.

If the State Council ’s standardization administrative department deems it necessary to establish a project, it shall work with the relevant administrative department of the State Council to make a decision. If it is really necessary to formulate a compulsory national standard, the department in charge of standardization administration under the State Council shall specify the project proposal department, and the reason for the project establishment shall be explained.

Article 11 The relevant administrative department of the State Council proposes mandatory national standard projects to the standardization administrative department of the State Council in accordance with its duties.

Compulsory national standard projects involving more than two relevant administrative departments of the State Council may be jointly proposed by the lead department and relevant departments.

Article 12 Before the relevant administrative department of the State Council proposes a mandatory national standard project, it shall fully solicit the opinions of other relevant administrative departments of the State Council to investigate the actual needs of enterprises, institutions, social organizations, consumers, education and research institutions, Demonstrate and evaluate the necessity and feasibility of the project.

Article 13 When the relevant administrative department of the State Council proposes a compulsory national standard project, it shall submit a project declaration form and a draft of the standard project.The project declaration should include the following :

(1) the necessity and feasibility of formulating mandatory national standards;

(2) main technical requirements;

(3) the formulation of relevant domestic mandatory standards and supporting recommended standards;

(4) the formulation of relevant laws, regulations and standards of the International Organization for Standardization, other countries or regions;

(5) Basis for supervision and management of the implementation of mandatory national standards and relevant laws, administrative regulations, and departmental rules for handling violations of mandatory national standards;

(6) Catalogues of products, processes or services covered by mandatory national standards;

(7) The situation of soliciting opinions from relevant departments of the State Council;

(8) budget and schedule;

(9) Other matters that need to be declared.

Article 14 The department in charge of standardization administration under the State Council shall review the mandatory national standard projects in accordance with the following requirements :

(1) Whether it complies with the principles stipulated in Articles 3 and 4 of these Measures;

(2) Whether it complies with the provisions of relevant laws and administrative regulations, and whether it is in harmony with the technical requirements of relevant mandatory standards;

(3) Whether it meets the requirements of Articles 12 and 13 of these Measures;

(4) Other contents that need to be reviewed.

Article 15 The department in charge of standardization administration under the State Council shall publicly solicit opinions from the public on the National Standard Information Public Service Platform, which complies with the mandatory national standard projects stipulated in Article 14 of these Measures.

Article 16 Regarding the opinions raised by the public, the department in charge of standardization administration under the State Council may organize expert demonstrations, convene meetings for coordination, or provide feedback to project proposal departments for research and processing, as needed.

Article 17 The competent department of standardization administration under the State Council shall decide whether to establish a project based on the review opinions and coordination.

Where more than two relevant administrative departments of the State Council are involved, they should also take the lead in organizing the drafting department.

国务院标准化行政主管部门应当以书面形式告知项目提出部门不予立项的理由。 If it is decided not to establish the project, the standardization administrative department of the State Council shall inform the project proposal department of the reasons for rejecting the project in written form.

Article 18 The organization drafting department may entrust the relevant standardization technical committee to undertake the drafting work.

If no standardization technical committee is formed, the organization drafting department shall set up a drafting expert group to undertake the drafting of mandatory national standards. For compulsory national standard projects involving more than two relevant administrative departments of the State Council, the lead organization drafting department shall set up drafting expert groups together with other organization drafting departments. The drafting expert group should be authoritative and representative.

Article 19 The technical requirements of compulsory national standards shall be all mandatory, verifiable and operable.

The compilation of compulsory national standards shall comply with the relevant national regulations, and in the foreword, the information of the organization's drafting department shall be included , but the specific drafting unit and drafter information shall not be involved.

Article 20 The compulsory national standards shall investigate, analyze, and demonstrate related matters.

If the relevant technical requirements need to be tested and verified, technical units with corresponding capabilities shall be entrusted to carry out the development.

Article 21 Drafting of compulsory national standards shall be accompanied by a compilation statement.The preparation instructions should include the following :

(1) Brief description of the work, including the source of the task, the drafters and their units, the drafting process, etc .;

(2) The basis for compiling principles and main technical requirements of mandatory national standards (including verification reports, statistical data, etc.) and reasons;

(3) The relationship with relevant laws, administrative regulations and other mandatory standards, and the formulation of supporting recommended standards;

(4) Comparison and analysis with relevant laws, regulations and standards of the International Organization for Standardization, other countries or regions;

(5) the process of handling major disagreements, their opinions and their basis;

(6) Suggestions and reasons for the transition period (hereinafter referred to as the transition period) from the date of publication of the mandatory national standards to the implementation date, including the technical transformation, cost input, and retirement of obsolete products required to implement the mandatory national standards Time, etc.

(7) Policies and measures related to the implementation of compulsory national standards, including the implementation of relevant laws, administrative regulations, and departmental regulations of supervision and management departments and handling of violations of compulsory national standards;

(8) Whether the suggestions and reasons for external notification are needed;

(9) Proposals to abolish the current relevant standards;

(10) Relevant explanations related to patents;

(11) Catalogues of products, processes or services covered by mandatory national standards;

(12) Other matters that should be explained.

Article 22 The organization drafting department shall solicit opinions in writing from the relevant administrative departments involved, as well as enterprises and institutions, social organizations, consumer organizations, education and research institutions.

Relevant administrative departments that solicit opinions in writing should include the implementation supervision and management departments of mandatory national standards.

Article 23 The organization drafting department shall publicly solicit opinions from the public through the department's portal and the national standard information public service platform on the draft of the mandatory national standard, drafting instructions, and the transition period.

The public comment period shall be no less than 60 days .In an emergency, the period for public comment can be shortened, but it should generally not be less than 30 days .

Article 24. For compulsory national standards involving a wide range of concerns, the organization's drafting department may take various forms such as forums, demonstrations, and hearings to hear opinions.

Article 25 For mandatory national standards that do not adopt international standards or are inconsistent with the technical requirements of relevant international standards and have a significant impact on the trade of other members of the World Trade Organization (WTO), the organization ’s drafting department shall The draft of the standard solicitation opinions and the Chinese and English communication forms are sent to the standardization administrative department of the State Council.

The department in charge of standardization administration under the State Council shall report to the outside world in accordance with the requirements of the World Trade Organization (WTO) and feed back the comments received to organize the drafting department.

Article 26 If there are major changes in the technical requirements of the compulsory national standards being formulated, they shall again openly solicit opinions from the public. If external notification is required, it shall be reported again.

Article 27 The organization drafting department shall modify the opinions of all parties to form a mandatory national standard for review.

Article 28 The organization drafting department may entrust the relevant standardization technical committee to undertake the technical review of submitting drafts of mandatory national standards for review.

Where a standardization technical committee has not been formed, the organization's drafting department shall set up a review expert group to undertake the technical review of the mandatory national standard submission review. For compulsory national standard projects involving more than two relevant administrative departments of the State Council, the lead organization drafting department shall work with other organization drafting departments to establish review expert groups. 不得少于十五人 The review panel shall be authoritative and representative, with a minimum of 15 members .

Draftsmen shall not undertake technical review work.

Article 29 The technical review shall take the form of a conference, focusing on the scientificity, rationality, applicability, and standardization of technical requirements, compliance with relevant policy requirements, and coordination with other mandatory standards.

The review meeting shall form the minutes of the meeting and be signed by all experts participating in the meeting. The minutes of the meeting should truly reflect the review, including the time and place of the meeting, the agenda of the meeting, the list of experts, specific review opinions, and review conclusions.

Article 30 Where the organization drafting department decides to submit the report for approval according to the technical review opinion, it shall form a draft for approval and send it to the standardization administrative department of the State Council for uniform numbering.

In the case of joint drafting by two or more relevant administrative departments of the State Council, the lead organization drafting department shall send the unified numbering to the standardization administrative department of the State Council with the consent of the drafting departments of other organizations.

Article 31 The organization drafting department shall provide the following materials and be responsible for the contents of the draft of the mandatory national standard report:

(1) submitting official documents;

(2) Manuscripts for approval of mandatory national standards;

(3) Preparation instructions;

(4) a summary processing form for soliciting opinions;

(5) Minutes of the review meeting;

(6) Other materials to be submitted.

The submission should include recommendations for the transition period .

提前三十日 向国务院标准化行政主管部门说明情况,并申请延长期限Article 32 If the mandatory national standard cannot be submitted within the time limit specified in the project plan, the organization drafting department shall explain the situation to the standardization administrative department of the State Council 30 days in advance and apply for an extension of the time limit .

Article 33 Before the mandatory national standard submits the serial number, if the organization drafting department considers that there are major problems or policy changes in the relevant technical requirements, it may reorganize the drafting or submit a proposal for project termination to the standardization administrative department of the State Council.

Article 34 The competent department of standardization administration under the State Council shall number mandatory national standards that meet the following requirements:

(1) Establishing procedures and specifications and complete submission materials;

(2) It complies with the principles stipulated in Articles 3 and 4 of these Measures;

(3) It complies with the provisions of relevant laws and administrative regulations, and harmonizes with the technical requirements of relevant compulsory standards;

(4) Properly handle major differences of opinion.

Article 35 The number of a mandatory national standard consists of the mandatory national standard code (GB), sequence number and year number.

Article 36 The competent department of standardization administration under the State Council approves the issuance of mandatory national standards in accordance with the authorization of the State Council. Mandatory national standards shall be issued in the form of an announcement by the standardization administrative department of the State Council.

Article 39 Prior to the implementation of a compulsory national standard, an enterprise may choose to implement the original compulsory national standard or the new compulsory national standard.

After the implementation of the new compulsory national standards, the original compulsory national standards will be abolished at the same time.

Article 40 After the publication of a compulsory national standard, information on drafting units and drafters may be queried through the National Standard Information Public Service Platform.

Article 41 After the publication of a compulsory national standard, one of the following situations shall be explained by the competent department of standardization administration under the State Council in accordance with the authorization of the State Council:

(1) The provisions of the compulsory national standards need to further clarify specific meanings;

(2) Where new circumstances arise, the basis for which mandatory national standards need to be clearly applied;

(3) Other matters that need explanation.

The draft of the compulsory national standard interpretation was proposed by the organization's drafting department and reported to the standardization administrative department of the State Council.

The interpretation of a compulsory national standard has the same effect as the standard. 二十日内 在全国标准信息公共服务平台上免费公开解释文本。 After the interpretation is released, the competent department of standardization administration under the State Council shall, within 20 days from the date of publication, make the interpretation text freely available on the national standard information public service platform.

Consultations on specific issues during the implementation of mandatory national standards will be studied and answered by the organization's drafting department.

Article 42 The department in charge of standardization administration under the State Council shall, through the national standard information public service platform, receive opinions and suggestions on the implementation of compulsory national standards from various parties in the society and provide timely feedback to the organization's drafting department.

Article 43 The organization drafting department shall collect the implementation effects and existing problems of the mandatory national standards, study and deal with them in a timely manner, and track and evaluate the implementation.

Where the implementation supervision and management department of the compulsory national standard and the organization drafting department are different departments, the supervision and management department shall timely report the administrative inspection, administrative punishment and other relevant information to the organization drafting department.

Article 44 After the implementation of a compulsory national standard, the organization drafting department shall regularly organize a statistical analysis of the implementation of the compulsory national standard, form a statistical analysis report of the implementation, and send it to the standardization administrative department of the State Council.

The statistical analysis report on the implementation of mandatory national standards should include an overall assessment of the implementation of mandatory national standards, as well as specific implementation effects, existing problems, and suggestions for improvement.

Article 45 The organization drafting department shall review the compulsory national standards based on the feedback and evaluation, propose the conclusions of continuing validity, amendment or abolition, and send them to the standardization administrative department of the State Council.

Article 46 If the review conclusion is a revision of a compulsory national standard, the organization drafting department shall propose a revision item when submitting the review conclusion.

The revision of compulsory national standards shall be carried out in accordance with the compulsory national standard setting procedures stipulated in these Measures; if individual technical requirements need to be adjusted, supplemented or deleted, and amended by means of a modification form, the project shall not be approved by the standardization administrative department of the State Council.

Article 47 If the conclusion of the review is to abolish the mandatory national standard, the standardization administrative department of the State Council shall openly solicit opinions from the public through the national standard information public service platform, and solicit opinions from the implementation supervision and management department of the mandatory national standard in written form. 不得少于三十日 Public comments are generally not less than 30 days .

If there is no major disagreement or is coordinated, the competent administrative department for standardization under the State Council shall abolish the mandatory national standards in the form of an announcement in accordance with the authorization of the State Council.

Article 48 In case of any disputes in the implementation of mandatory national standards, the competent department of standardization administration under the State Council shall organize consultations; if no consensus is reached after consultation, they shall be submitted to the State Council for Standardization, Coordination and Advancement of Inter-Ministerial Joint Meetings for study and resolution.

Article 49 Any unit or individual has the right to report or complain to the administrative department for standardization and the relevant administrative department for violations of these Measures.

The standardization administrative department and relevant administrative departments shall handle the matter according to their duties. For the real-name whistleblower or the complainant, the results of the processing shall be notified, the whistleblower shall be kept confidential, and the whistleblower shall be rewarded in accordance with the relevant state regulations.

Article 50 Where national secrets are involved in the formulation of compulsory national standards, the relevant confidentiality provisions shall be observed.

Article 51 Where a compulsory national standard involves a patent, it shall be implemented in accordance with the relevant national regulations governing patents.

Where a compulsory national standard is formulated with reference to relevant international standards, the copyright policy of the relevant international standardization organization shall be complied with.

Article 52 The enterprises referred to in these measures include domestic-funded enterprises and foreign-invested enterprises. Mandatory national standards apply equally to domestic and foreign-invested enterprises. Foreign-invested enterprises shall participate in the formulation and revision of mandatory national standards on an equal basis in accordance with the law and domestic-funded enterprises.

Article 53 The dates referred to in these measures are the Gregorian calendar days.

Article 54 Where laws, administrative regulations and decisions of the State Council provide otherwise for the formulation of compulsory standards, such provisions shall prevail.

Article 55 These Measures shall be implemented as of June 1, 2020 . If the content of the relevant departmental regulations concerning the management of mandatory national standards is inconsistent with the provisions of these Measures, the provisions of these Measures shall prevail.
